PROSECUTION CLOSES CASE IN NNAMDI KANU’S TERRORISM TRIAL AFTER FIFTH WITNESS TESTIMONY

In a major development in the ongoing terrorism trial of Nnamdi Kanu, leader of the banned Indigenous People of Biafra (IPOB), the Federal Government has officially closed its case after presenting its fifth and final witness.

Fifth Witness and Evidence
Known only as “PW‑5” and identified as a Department of State Services (DSS) officer, the witness testified under a protective shield, revealing he was tasked with gathering and assessing data on the aftermath of the End SARS protests from 2020–2021.

In court, he presented the following evidence:
• A comprehensive DSS report detailing destruction of public property and fatalities during the protests
• Death certificates for 128 police officers, 37 army personnel, and 10 DSS agents
• A list of 164 destroyed police stations and 19 INEC facilities

During cross-examination, the officer acknowledged he did not directly link Kanu to the End SARS events but stated that Kanu’s broadcasts had “incited the public,” characterizing them as part of broader subversive activities .

Closing the Federal Government’s Case
After the five witnesses were heard, prosecuting counsel Chief Adegboyega Awomolo, SAN, announced the closure of the government’s case.

He stated that the evidence presented—witness testimonies and exhibits—had met the required burden in court .

In response, Kanu’s lead counsel, Chief Kanu Agabi, SAN, declared that the defense will submit a “no-case submission,” arguing that the prosecution failed to establish a prima facie case warranting further defense by the accused .

Justice James Omotosho granted both parties a 14-day window to file their legal briefs and scheduled the next hearing for July 18, 2025, to adopt the submissions .
